Rape victim court cases outmoded says top judge
Scotland’s most senior judge, Lord Carloway, has criticized the justice system for its outdated practices when dealing with vulnerable victims, particularly rape victims and children.
Lord Carloway suggested that children should be spared cross-examination by defense lawyers, a proposal that has faced opposition from some members of the legal profession.
Four women in the Logan Doig rape case spoke out about the traumatic court process, stating that they were left “battered and bruised” by the way they were treated during the trial.
Lord Carloway highlighted the delays in rape cases reaching the high court, which have doubled since the Covid pandemic, and expressed doubt that the pre-pandemic levels could be achieved due to resource constraints.
