“If there is a lawsuit in the state of South Dakota because of a law we pass,” said Rep. Jon Hansen, Republican for Dell Rapids, “it’s worth every penny.
House bill 1217, argue supporters, would ensure fair competition in gender-separated sports by creating a list of requirements for sanctioned sports that would effectively prohibit transgender participation. Supporters say there are potentially unfair advantages in physique for girls who line up or race against male-born competitors.
“Boys, men are now allowed to participate in women-specific sports even in the state of South Dakota,” Rep. Rhonda Milstead, a Republican from Hartford, the main sponsor of the legislation.
Critics of the measure, including the high school sports governing body, responded that the bill distorts the vast majority of trans athletes and would prevent trans students from participating in sports.
