Delhi HC adjourns hearing on plea against privacy policy WhatsApp

The Delhi High Court on Monday adjourned the hearing of a petition against WhatsApp’s new privacy policy to April 19 after the central government asked for more time to examine the issue.

A single-member bench of Justice Sanjeev Sachdeva asked the center to file a status report and placed the matter on the agenda for April 19.

The court noted that the government is investigating the issue and gave the center more time to respond to the case.

Attorney Kirtiman Singh, acting on behalf of the Center, told the Court that the government is in the process of obtaining certain clarifications and needs time to study them.

He also told the court that the Supreme Court has already issued a communication on a similar request regarding WhatsApp’s updated policy.

During the last hearing, the central government had told the Delhi High Court that the different treatment of Indian users with regard to WhatsApp’s privacy policy is a matter of concern because the messaging application’s policy differs for users in the European Union.

The government told the court that the Data Protection Bill is pending and WhatsApp’s response has been sought by the central government and that the center is concerned about how Indian users are not being given the option to choose.

The court was hearing a petition for an injunction against WhatsApp’s updated privacy policy. The petition was filed by Chaitanya Rohilla through lawyer Manohar Lal.

Manohar Lal, lawyer for the petitioner, told the court that the government had introduced a data protection bill, but it never saw the light of day.
